Statutory Rights and  Obligations of 
Voluntary Organisations

It is well-known that church related organisations for philanthropic purposes have done commendable job among people such as tribes and other disadvantaged groups.  The government recognizes this fact and tries to follow their example wherever possible among similar disadvantaged groups.   After Independence institutions inspired by Mahatma Gandhi also did commendable job among the weaker sections of society.  However, more recently there is a proliferation of institutions and societies irrespective of church or Gandhian affiliations.

All these institutions and societies are either registered under Societies Registration Act XXI of 1860 or are operating as public trusts.  The proliferation of such societies and trusts may be a good sign in view of the vast potentials, but more recently Government  is taking a cautious view of such proliferation of societies.  The main contention of government is that most of the societies are misutilizing resources provided either by government or other donors.  Therefore, government recently issued several press notices asking all these societies to furnish obligatory statements required by law.  It has also issued strictures for further registration of societies unless and until certain conditions are fulfilled.

The following four laws relating to voluntary organisations will be dealt with in depth in the training sessions:

1.  Societies Registration Act and Rules

2.  Foreign Contribution (Regulation) Act

3.  Income Tax Act

4.  Employees Provident Fund Act.
